General Terms and Conditions – BLΛCK MIST

1. Applicability

These terms and conditions apply to all offers, orders, and agreements made with BLΛCK MIST, unless explicitly agreed otherwise in writing.

2. Prices and Payment

  • All prices are stated in euros and include VAT, unless otherwise specified.
  • Payment must be made within 14 days of the invoice date unless agreed otherwise.
  • In case of late payment, BLΛCK MIST reserves the right to charge statutory interest and collection costs.

3. Delivery

  • Products are delivered via postal service, personal delivery to the client’s address, or can be picked up in-store, depending on the customer's selection at checkout.
  • Shipping or delivery will take place as soon as possible after receipt of payment.
  • Delivery times are indicative and not legally binding. Delays do not entitle the customer to compensation or cancellation of the order.
  • The risk of damage or loss transfers to the customer once the package has been handed over to the postal carrier or delivered in person.

4. Right of Withdrawal (EU Consumers)

  • Consumers have the right to withdraw from their purchase within 14 days after receiving the goods, without providing any reason.
  • During this period, the customer must handle the product and packaging with care.
  • If exercising the right of withdrawal, the customer must return the product, including all accessories, in its original condition and packaging.

5. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Products with a limited shelf life or that perish quickly.
  • Sealed products which are not suitable for return for health or hygiene reasons if the seal has been broken.
  • Goods that are inseparably mixed with other items after delivery.

6. Warranty and Complaints

  • For private consumers, our products are covered by the statutory 2-year legal guarantee from the date of delivery, in accordance with EU consumer law.
  • For business customers (purchases made in the name of a company or using a company VAT number), a 1-year warranty period applies, unless agreed otherwise in writing.
  • Complaints about defects must be reported in writing within a reasonable time after discovery.
  • If a product is defective within the warranty period, we will offer a replacement, repair, or refund, depending on the situation.
  • Warranty does not apply in cases of misuse, accidental damage, or improper maintenance.

7. Liability

  • Our liability is limited to the purchase price of the product.
  • We are not liable for indirect damage, consequential loss, or loss of profit.

·         Allergies and Sensitivities: While our fragrance products are crafted with high-quality ingredients, they may contain substances that can cause allergic reactions or sensitivities in certain individuals. Customers are advised to review the ingredient list carefully and conduct a patch test before full use. BLΛCK MIST is not liable for any adverse reactions resulting from known or unknown allergies.

·         Overuse and Misuse: Excessive or improper use of our products, such as over-spraying in confined spaces or direct application to the skin, can lead to health complications. Users should follow the recommended usage instructions. BLΛCK MIST disclaims responsibility for any issues arising from misuse or overuse of our products.

·         Legal Compliance: BLΛCK MIST complies with all applicable EU regulations regarding product safety and labeling. Our liability is limited to the maximum extent permitted by law.

8. Force Majeure

In case of force majeure, we are not obligated to fulfill our contractual obligations. Force majeure includes any external circumstance beyond our control that prevents or delays delivery.

9. Privacy

We respect your privacy and process personal data in accordance with the General Data Protection Regulation (GDPR).More details can be found in our privacy policy.

10. Applicable Law and Disputes

All agreements and disputes between BLΛCK MIST and the customer are governed by Belgian law. Disputes will be submitted to the competent court in the district where BLΛCK MIST is established.
